Q: Should I file for bankruptcy?

A: The fact that you are thinking about it is a good indication that you should. But the best way to determine if you should file is to come in and see us to discuss your options.

Q: Will my bankruptcy be publicized?

A: No, it will not. You don’t have to worry about undue exposure or being stigmatized. Bankruptcy filings are not published in newspapers or other public forums.

Q: Will my employer find out?

A: No. When you file for bankruptcy, no one is informed of the action.

Q: How quickly can I file for bankruptcy?

A: You can file as soon as you give us the information needed to file. We often can file the same day if we have all of your files and financial records. We realize that foreclosures occur on the first Tuesday of every month. To stop foreclosure, we recommend scheduling an appointment with us immediately. We will always try to file quickly in order to prevent foreclosure.

Q: Will I lose my home and car if I file for bankruptcy?

A: No. When you file, an automatic stop is put into place that prevents foreclosure, repossession and further harassing calls from creditors.

Q: Should I file for Chapter 7 or Chapter 13 bankruptcy?

A: Our firm will give you a means test designed to determine which type of bankruptcy is right for you. In some cases, we are even able to challenge the results of the test if you believe you should file for Chapter 7 and the test finds you ineligible.

Q: What about my credit — will it improve?

A: Because bankruptcy wipes the slate clean, you are able to start fresh and begin forming habits that establish good credit. As you maintain good credit and pay your bills on time, your credit will improve.

Q: Will my bankruptcy show up on my credit report?

A: Yes, however this should not be a detriment to obtaining and rebuilding credit.
